This data processing falls under the remit of NOWJOBS NV, with its registered office at 576 Beversesteenweg, 8800 Roeselare, Belgium, and registered with the CBE under number 0809.928.917.

NOWJOBS aims to comply with ‘the Law of 30 July 2018 concerning the protection of natural persons with regard to the processing of personal data, for the transposing, supplementing and implementing of the European Regulation 2016/679 of 27 April 2016 concerning the protection of personal data’, as well as with ‘the anti-spam provisions from Book XII of the Code of Economic Right concerning the ‘right of the electronic economy’ (in as far as applicable)’.
1.3. By using the Website and/or the App and/or providing personal data to NOWJOBS, you unconditionally and irrevocably agree to the provisions of this Privacy Policy.

You declare that all information you have provided or will provide to NOWJOBS is true, correct and non-misleading. Please remember to inform NOWJOBS of any change to your personal data if this information is relevant to NOWJOBS.
Article 3 – Personal data collected indirectly
3.1. Public data pertaining to the outsourcer, client or other business entity
NOWJOBS processes some public data, e.g., data that is subject to a duty of publication, such as the publication of your appointment as the director of a company, or data you have made public yourself, such as information on your website, or data that is generally known in your area or that has been published in the media, or data listed on e.g. the Crossroad Bank for Enterprises and Graydon.
Article 4 – Processing objectives
4.1. General objectives and legal basis:
NOWJOBS exclusively uses collated personal data for the following purposes:
• Electronic identification data:
o To maintain and improve the Website and the Apps;
o The legal basis is NOWJOBS's legitimate interests to constantly improve its Website, Apps and services and to ensure the proper functioning and growth of NOWJOBS. In any case, NOWJOBS's legitimate interests must not and will not outweigh your privacy interests.
• Identification data:
o To provide you with the requested information or services;
o To offer our services in the best possible way;
o To tailor our services and ensure that the right profiles are matched; in this context, we may use profiling and data completion/enrichment techniques;
o The legal basis is the performance of a contract or your explicit, prior consent.
• Professional and/or educational details:
o To assess whether you are a suitable candidate for a vacancy;
o To contact you if we have either or not rejected your application, and to invite you for an interview;
o To contact you should a relevant position arise in the near future;
o To offer our services in the best possible way;
o In order to tailor our services and to ensure that the right profiles are matched, we may use profiling and data enrichment techniques in this context;
o With the legal basis of the performance of an agreement or on the basis of the legitimate interest of NOWJOBS to inform you about the assessment of your application.
• Data for payroll administration:
o For the payment of wages and employee benefits, holiday allowances, or other payments due under the employment contract;
o The legal basis is the performance of a contract.
• Photos and videos
o To be used in our internal communications
o With your explicit, prior consent as the legal basis
• Chat session content:
o In order to maximally prevent (social/fiscal and competitive law) misuse of our app, NOWJOBS can scan the chat session content via automatic word recognition, and take appropriate measures where necessary. Under no circumstances shall the chat session information be used for commercial purposes on the part of NOWJOBS.
o With as legal basis your explicit, prior consent.
You are not obliged to release your personal data, but you do understand that the granting of certain services becomes impossible if you refuse the processing.
4.2. Direct marketing:
Personal data may also be used for direct marketing purposes (e.g. promotions and marketing campaigns in connection with our services).
Direct marketing relating to NOWJOBS’s services may be sent to existing customers of NOWJOBS and its affiliated companies, based on our legitimate interests to ensure the proper functioning and growth of our business. These legitimate interests must not and will not in any case outweigh your privacy interests.
Before sending direct marketing (e.g. promotions and marketing campaigns within the scope of our services) to candidates, temporary employees and prospects, explicit permission will always be requested.
This consent may be withdrawn at any time, without justification and without charge: see Articles 6,9 and 12 concerning the withdrawal of your consent.
4.3. Forwarding on to third parties:
4.3.1. Transfer to third-party service providers
NOWJOBS may pass on your personal data to third party service providers providing technical and operational support and to third party service providers in general (e.g. lawyers, auditors, etc.) in so far as this is necessary for the professional provision of services and/or if it is required to do so on the basis of a statutory provision or a court ruling.
4.3.2. Intra-group data transfers
NOWJOBS will not sell your personal data, rent them out, share them or otherwise make them commercially available to third parties, except as described above.
NOWJOBS is part of the House of HR group, which includes several companies that are active in the field of staffing and human resources. More information on the House of HR Group and its member companies can be found here: https://www.houseofhr.com/companies.
NOWJOBS may share the personal data it processes with other companies within House of HR Group in the context of intra-group cooperation and/or intra-group services in order to improve, facilitate and simplify the activities and services of NOWJOBS and House of HR Group (for example ICT services, accounting, analyses and statistics, debtor management, direct marketing, etc.).
In certain cases, NOWJOBS may act as a joint data controller for the processing of your personal data together with other companies of the House of HR Group. This means that they will then jointly determine the purpose of and means for processing your personal data. In this case, they are jointly responsible for compliance with applicable data protection legislation. However, NOWJOBS remains your main point of contact, also for exercising your rights in respect of your personal data (for more information on exercising your rights, see Article 6).
4.3.3.Transfer to third countries:
NOWJOBS may transfer your personal data outside the European Economic Area in order to process the data in accordance with this Privacy Declaration. In the event that data is transferred outside the European Economic Area, to a country that does not offer an adequate level of protection, NOWJOBS guarantees that it will take all measures to protect your personal data, including the implementation of contractual provisions that offer adequate data protection guarantees for the data that will be transferred internationally.
4.3.4. Legal requirements:
In rare cases it may happen that NOWJOBS must reveal your personal data as a result of a court order or in order to comply with other compelling laws or regulations. NOWJOBS shall make reasonable attempts to inform you in advance about this, unless it is subject to legal restrictions.
Article 5 – Processing duration
5.1. The personal data are kept and processed by us for a period that is necessary in light of the purposes of the processing as described in article 3 and in light of the contractual relationship between NOWJOBS and you:
• Electronic identification data, such as IP address: for the duration of your visit to the Website or App;
• Identification data: for the duration of the requested provision of services;
• Data of candidates and/or temporary employees:
• If you have ever been employed through NOWJOBS: We keep your data for 10 years after the end of the last employment contract, because of possible commercial claims and accidents at work. Pay slips, evaluation documents and CVs will be deleted after 5 years.
• If you have never been employed via NOWJOBS: All candidates with whom there has been no contract or contact in the last 5 years will be deleted. All candidates will be kept in the database for 5 years, in the context of discrimination claims. Of candidates in the database where the last contact moment is 5 years ago, the documents (such as the CV) and personal data (such as mobile phone and email) will be automatically deleted after 5 years.
• Identification data of the client, customer or other business relationship: for the duration of the requested provision of services and for compliance with our legal obligations;
• Photos and videos: for the duration of the requested provision of services
5.2. The aforementioned personal data are in any case kept in accordance with the specific statutory provisions, as well as the prescription periods that oblige us to keep your personal data for a longer period, e.g. in order to defend ourselves against an action at law.
Article 6 – Your rights
6.1. You have the right to request access to, limitation of, correction or deletion of your personal data at any time. You have the right to withdraw your consent, object to the processing of personal data or request the transfer of such data.
6.2. You can exercise your rights by contacting us (contact details can be found in Article 10). We are entitled to ask you to prove your identity in order to prevent anyone from gaining unauthorised access to your data.
6.3. NOWJOBS is not always obliged to accede to your request to exercise your rights - your rights only apply in the cases and to the extent provided for by law.

Article 7 – Security and confidentiality
7.1. We have devised specific technical and organisational security measures that prevent elimination, loss, falsification, amendment, unauthorised access and wrongful disclosure to third parties of any personal data collated, as well as any other form of unauthorised processing of this data.
7.2. In no instance can NOWJOBS be held liable for any direct or indirect damage arising from erroneous or unlawful use of such personal data by a third party. NOWJOBS has put steps in place to ensure any third party appointed to process personal data adheres to the same regulative procedures.
7.3. You are obliged to comply with the security provisions at all times, which includes safeguarding your login details and code to prevent unauthorised access. You are therefore solely responsible for all Website use via your computer, IP address and ID details, as well as for the confidentiality thereof.
Article 8 – Third Party Access
8.1. In order to process your personal data it is made accessible to our employees.
8.2. We guarantee a unilateral degree of protection by rendering contractual obligations enforceable to these employees and appointed persons; ones that are in line with this Privacy Policy.

Article 10 – Applicable law and competent court
This Privacy Policy is exclusively governed, construed and implemented pursuant to Belgian law.
The Kortrijk courts enjoy sole jurisdiction should any dispute arise in relation to the interpretation or implementation of this Privacy Policy.
In the event of inconsistency between the English and French Privacy & Cookie Policy with the Dutch version, the latter takes precedence.
